Terms of use of goout.net website

I. Terms of use

The goout.net website is owned and operated by GoOut s.r.o., Company Registration No: 01901613, Tax registration No.: CZ01901613, having its registered office at Mánesova 917/28, 120 00 Prague 2, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 212454 (hereinafter referred to as “GoOut” or the “Operator”). Before accessing the goout.net website, the User undertakes to comply with these Terms of use of the goout.net website (hereinafter referred to as the “Terms of use”), as well as all applicable and generally binding laws of the Czech Republic. Users also undertake to refrain from harming the reputation of GoOut or the website itself.

The goout.net website itself and as a whole constitute a copyright work within the meaning of Sec. 2 of Act no. 121/2000 Sb., the Copyright Act, as amended. The Operator enjoys all rights to the content of the website as a whole, under the license pursuant to the Copyright Act. The Operator is also entitled to use individual elements of website under license, in particular photographs, design, graphics, logos, texts, sounds, etc. Any part of the content of the goout.net website may be used without GoOut’s prior consent for private purposes only. It is prohibited to publish, copy, distribute and use for commercial purposes in any way the content of the goout.net website without GoOut’s prior express and written consent. If copyrights are infringed upon, GoOut will demand compensation for material and non-material injury and any other claims guaranteed by Czech legislation.

III. The Manner of Use of the Website

  1. The User acknowledges and agrees to enter the goout.net website and understands that it is forbidden, in particular, to: interfere with the security, technical nature or content of the goout.net website or misuse them in any other way; interfere with the usage of this website by other users; use the website for sending unsolicited messages (spam), chain mail, messages containing viruses or any harmful or malicious programs to this website; attempt to access those parts of the goout.net website that are excluded from use by the public, in particular the source code, etc.; distribute messages or materials violating applicable generally binding legislation of the Czech Republic on this website.
  2. Users also undertake to refrain from harming the reputation of GoOut or the website itself. If watching videos on goout.net, the user agrees to follow YouTube Terms of Service.

IV. Limitation of GoOut’s Responsibility

  1. The provisions of this article do not apply to the legal relations arising from the sale of Tickets through the goout.net website, which are governed by the Terms of ticket purchase.
  2. The content of the goout.net website is only informative and non-binding. The Operator is not liable for the accuracy and completeness of the information on this website. The publication of such data and information on this website, except for these Terms of Use, does not constitute a legal action aimed at establishing a legal relationship between the Operator and the User.
  3. The Operator is not liable for any damage caused to the User as a result of following the content of the goout.net website and in connection with the use of this website.
  4. The Operator is entitled to make any changes to information and content of the goout.net website without prior notice at any time.
  5. The Operator is also not liable for advertising or any other form of promotion by any third party through the goout.net website.
  6. Furthermore, the Operator is not liable for the content of websites of third parties that may be accessed through the goout.net website.

IV. User profile and registration

Users can create their own profile on the goout.net website. Terms for creating and using the profile are governed by separate Terms of user profile and registration. Using the goout.net website and/or purchasing Tickets through this website does not require profile creation or registration.

VI. Contests

  1. GoOut (hereinafter referred to as the “Organizer”) organizes contests on the goout.net website, in which a natural person having full capacity to perform legal acts may participate. GoOut reserves the right to reduce the duration of, interrupt or cancel the contest or change its rules.
  2. Anyone who accepts the contest rules, fulfils the terms of these rules, and also fulfils the following conditions may become a contest Participant: The Participant will answer a contest question according to contest specifications through SMS, e-mail, answer form or other alternative means of answering. The Participant will send an answer to the contest question in a manner specified and according to instructions in the contest specifications. The Participant will also provide their first name, surname and phone number or e-mail address unless the contest specification stipulates otherwise. The contest Participant agrees that their name and surname be published in the contest results listed on the Organizer’s website or in magazines issued by the Organizer.
  3. The contest begins on the day that the Organizer announces the contest on their website and ends on the day specified in the contest specifications. The Organizer will not accept SMSs, e- mails, answer forms and responses sent by other means that arrive after this date. The contest will be evaluated no later than within one month after the contest has ended. The prizes will be claimed by the number of contestants specified in the contest specifications pursuant to the rules stated therein. The Organizer of the contest reserves the right to check compliance with the terms of participation in the contest and to assess prize eligibility. The Organizer of the contest reserves the right to make final decisions in the case of dispute at its sole discretion. Legal proceedings may not be brought against the winner of the prize. The Organizer is not liable for any technical defects in electronic communication during the contest and is not liable for difficulties in the contest resulting from any technical failure or traffic congestion on the network.
  4. Prizes are awarded to the winners by the Organizer or by the company specified in the contest specifications. Prizes are accepted by the winners at their own risk, and, by accepting the prize, the winner takes full responsibility for any damage that may be caused to the winner or third parties by using or utilizing the prize. The Organizer of the contest is not liable in any event for any damages caused to the winners or third parties by the prizes nor for any damages incurred in connection with use or utilization of the prizes.

VI. Final Provisions

  1. If any provision of these Terms of use proves to be invalid or ineffective, the validity or effectiveness of other provisions of these Terms of use that are severable from the invalid or ineffective provision remains unaffected.
  2. The Operator reserves the right to modify the wording of these Terms of use.
  3. All provisions of these Terms of use and the contractual relationship between the Promoter, the Purchaser and GoOut are governed by Czech legislation.
  4. All disputes arising from the purchase of tickets through GoOut will be settled by the ordinary courts of the Czech Republic unless they are resolved out of court.
  5. These Terms of use enter into force and effect upon their publication on the goout.net website.
